Consignment Terms & Conditions
1. All items submitted for consignment are subject to review and approval by Spit and Polish. We reserve the right to decline any item that does not meet our quality, style, or brand standards. Items not accepted will be returned to the consignor.
2. The consignor agrees to leave the approved items with Spit and Polish for sale on a consignment basis.
3. Of the final sale price: 15% will be donated to animal rescue. The remaining 85% will be divided between the consignor (60%) and Spit and Polish (40%) — meaning the consignor receives 51% of the final sale price and Spit and Polish retains 34%, with 15% going to animal rescue.
4. Items will be listed at a price agreed between both parties. No item will be sold below the agreed minimum price without prior consent.
5. Unsold Items. If an item remains unsold after three (3) months from the date it is accepted for consignment, the Vendor may: (a) collect the item; or (b) authorise Spit and Polish to continue offering the item for sale at a reduced price. Spit and Polish may contact the Vendor by email, text message, telephone, or any other contact details provided by the Vendor to discuss these options.
6. Abandoned Items. If an item remains uncollected and the Vendor has not responded to Spit and Polish within four (4) months of the consignment date, despite at least one reminder being sent using the contact details provided, the item shall be deemed abandoned. Upon being deemed abandoned: ownership of the item shall transfer to Spit and Polish; the Vendor shall have no further claim to the item or any proceeds from its sale; and Spit and Polish may sell, donate, dispose of, or otherwise deal with the item at its sole discretion.
7. Spit and Polish will take reasonable care of all consigned items but cannot be held liable for loss or damage beyond reasonable control.
8. Payment for sold items will be made to the consignor within 14 days of the sale.
9. Entire Agreement. This Agreement constitutes the entire agreement between the parties and supersedes any prior discussions or understandings relating to the consigned items.
10. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of Malta.
